Foreign Ownership
In general, foreigners can’t own property in Thailand. There are a few exceptions to this law which deal with condominiums and Board of Investment promotions to allow corporate housing in designated areas.
As Thailand is, for all intent and purposes, a ‘community property state’, Thai nationals who marry foreigners and wish to buy land must have their spouse sign an affidavit stating that the funds used to purchase it are the separate funds of the Thai spouse and the foreign spouse has no interest whatsoever in the land.
If questioned, the Thai spouse may also be required to show the source of the funds.
